    Q. How secure is my data?

    A:

    We Use:

    • Data Encryption with 256-bit SSL Certificate  (https: secure communication between you and our servers)
    • Web Firewall to protect against DOS and DDOS attacks
    • Web Firewall also to protect against online attacks
    • Your Credit Card data is secure and stored with stripe.com (industry leader) on their top of the line security servers (not ours).
    • Your client data is encrypted in transit and at rest with Amazon Web Servers located inside the United States at their secure sites.
    • Servers with additional built-in security based on server operating system.
    • We undergo regular security audits to verify security practices and technology are current.
    • Your data is stored and backed up as well on our servers.

     

    Q. How long does it take for forms to be updated in PrimaFacie when a new version is released?

    A: The exact time will vary based on the complexity of the form. We understand it is important to use the latest version of the form, even if use is not currently required. Our goal is to have most forms in PrimaFacie updated within 1 week of a form update. A longer form like the N-400, with barcodes may take longer.

     

    Q: Does PrimaFacie have all US Immigration Forms?

    A: PrimaFacie contains all forms published by USCIS, EOIR, DOL (ETA Forms) and ICE. If you happen to find another immigration form you think we should include, simply email us at [email protected] and we will process your request.

     

    Q: Does PrimaFacie autofill forms?

    A: Yes. PrimaFacie will automatically fill in all of the form fields it can with the information you have already entered. If the same data is required on multiple forms, you enter it once, and it autofills the rest, saving you time, guaranteeing consistent data entry and avoiding scrivener’s errors.

     

    Q: Is it difficult to learn how to use PrimaFacie?

    A: PrimaFacie is easy to learn. It was designed for simplicity and ease of use. Anyone familiar with basic web applications or computer software can learn how to use PrimaFacie in minutes. We designed it to be simple and intuitive with all the features that you need to make life easier for you and your staff. You can find videos and information on how to perform simple tasks on our support page here.

     

    Q: Does this work on Mac and PC?

    A: Yes, PrimaFacie is web-based and works with any modern browser. As such, it will run on a Mac or PC, and even on your mobile device. PrimaFacie does not require any special software install.

     

    Q: Can I see how it works before I buy?

    Q: Is my credit card information secure?

    A: Yes. All payment information is processed via Stripe and is done so in accordance with the highest security standards (here for more information from Stripe).

     

    Q: Is my client information secure?

    A: Yes. Your information is encrypted and stored on Amazon’s Web Services, following the highest industry standards for web security (here for more information from Amazon).

     

    Q: Who owns the information that I enter into PrimaFacie?

    A: You do. You own the data. It is stored on our servers. You pay us to access it and store it and manipulate it to fill out forms etc… but the data is yours. If one day you decide to leave us, we can export it into a common database language and send it to you. Please note that there is an additional cost for this as indicated in the Terms of Service.

     

    Q: How were the case template items (checklists and caseflows) created?

    A: We have an immigration attorney on staff who helped us prepare these items. *Legal Disclaimer* While they are not legal advice, and while there is no substitute for legal advice by a licensed practitioner, the checklists can assist you in assembling the required documents for the particular case. The caseflows, likewise, are general guidance in the steps necessary to complete each case type.

     

    Q: Are there other apps I should use in order to enjoy PrimaFacie completely?

    A: We recommend using a cloud storage solution for your data, like Dropbox. Also, IDPhotoPrint is a useful app for taking passport photos that you can upload to PrimaFacie for use in the Contact Profile. If you are a current Clio subscriber (www.goclio.com), PrimaFacie can sync contact information from your Clio account, so you can avoid entering duplicate data. You can quickly and seamlessly search for clients that exist in your Clio account and import them into PrimaFacie with a few clicks.

     

    Q: Does PrimaFacie do invoices, time tracking, calendaring, document templates or trust accounting?

    A: PrimaFacie syncs very seamlessly with Clio (www.goclio.com), and Clio can do all of those things. Clio is the leader in online case management software with an impressive array of third party apps you can use to run your modern practice. With a PDF reader and modern web browser, you’ll be good to go. If you are a current Clio subscriber, PrimaFacie can sync contacts from your Clio account, so you can avoid entering duplicate data. You can quickly and seamlessly search for clients that exist in your Clio account and import them into PrimaFacie with just a few clicks.

    PrimaFacie Terms of Service

    Addendum 1

    BREVORT RIVER STUDIOS GDPR COMPLIANCE ADDENDUM

    To the extent that BREVORT RIVER STUDIOS (BRS) Processes any Subscriber Personal Data (each as defined below) and (i) the Subscriber Personal Data relates to individuals located in the EEA; or (ii) Subscriber is established in the EEA, the provisions of this GDPR Compliance Addendum (CA) shall apply only to the processing of such Subscriber Personal Data. In the event of any conflict between the terms of service and the CA, the CA will prevail.

    1. Definitions

    1.1. The following capitalized terms used in this CA shall be defined as follows:

    (a) “Controller” has the meaning given in the GDPR.

    (b) “Data Protection Laws” means the EU General Data Protection Regulation 2016/679 (“GDPR“), any applicable national implementing legislation in each case as amended, replaced or superseded from time to time, and all applicable legislation protecting the fundamental rights and freedoms of persons and their right to privacy with regard to the Processing of Subscriber Personal Data.

    (c) “Data Subject” has the meaning given in the GDPR.

    (d) “European Economic Area” or “EEA” means the Member States of the European Union together with Iceland, Norway, and Liechtenstein.

    (e) “Processing” has the meaning given in the GDPR, and “Process” will be interpreted accordingly.

    (f) “Processor” has the meaning given in the GDPR.

    (g) “Security Incident” means any confirmed accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, any Subscriber Personal Data.

    (h) “Standard Contractual Clauses” means the Standard Contractual Clauses (processors) approved by European Commission Decision C(2010)593 or any subsequent version thereof released by the European Commission (which will automatically apply).

    (i) “Subprocessor” means any Processor engaged by BREVORT RIVER STUDIOS who agrees to receive from BREVORT RIVER STUDIOS Subscriber Personal Data.

    (j) “Subscriber Personal Data” means the “personal data” (as defined in the GDPR) described in the Annex and any other personal data contained in the Content or that BREVORT RIVER STUDIOS processes on Subscriber’s behalf in connection with the provision of the Service.

    (k) “Supervisory Authority” has the meaning given in the GDPR.

    2. Data Processing

    2.1. The Parties acknowledge and agree that for the purpose of the Data Protection Laws, the Subscriber is the Controller and BREVORT RIVER STUDIOS is the Processor.

    2.2 Instructions for Data Processing. BREVORT RIVER STUDIOS will only Process Subscriber Personal Data in accordance with Subscriber’s written instructions. The parties acknowledge and agree that the Agreement (subject to any changes to the Service agreed between the parties) and this CA shall be Subscriber’s complete and final instructions to BREVORT RIVER STUDIOS in relation to the processing of Subscriber Personal Data.

    2.3. Processing outside the scope of this CA or the Agreement will require prior written agreement between Subscriber and BREVORT RIVER STUDIOS on additional instructions for Processing.

    2.4. Required consents. Where required by applicable Data Protection Laws, Subscriber will ensure that it has obtained/will obtain all necessary consents and complies with all applicable requirements under Data Protection Laws for the Processing of Subscriber Personal Data by BREVORT RIVER STUDIOS in accordance with the Agreement.

    3. Transfer of Personal Data

    3.1. Authorized Subprocessors. Subscriber agrees that BREVORT RIVER STUDIOS may use the following as Subprocessors to Process Subscriber Personal Data:

    3.2. Subscriber agrees that BREVORT RIVER STUDIOS may use subcontractors to fulfill its contractual obligations under the Agreement. BREVORT RIVER STUDIOS shall notify Subscriber from time to time of the identity of any Subprocessors engaged. If Subscriber (acting reasonably) objects to a new Subprocessor on grounds related to the protection of Subscriber Personal Data only, then without prejudice to any right to terminate the Agreement, Subscriber may request that BREVORT RIVER STUDIOS move the Subscriber Personal Data to another Subprocessor and BREVORT RIVER STUDIOS shall, within a reasonable time following receipt of such request, use reasonable endeavors to ensure that the original Subprocessor does not Process any of the Subscriber Personal Data. If it is not reasonably possible to use another Subprocessor, and Subscriber continues to object for a legitimate reason, either party may terminate the Agreement on thirty (30) days written notice. If Subscriber does not object within thirty (30) days of receipt of the notice, Subscriber is deemed to have accepted the new Subprocessor.

    3.4. International Transfers of Subscriber Personal Data. To the extent that the Processing of Subscriber Personal Data by BREVORT RIVER STUDIOS involves the export of such Subscriber Personal Data to a third party in a country or territory outside the EEA, such export shall be:

    (i) to a country or territory ensuring an adequate level of protection for the rights and freedoms of Data Subjects as determined by the European Commission;

    (ii) to a third party that is a member of a compliance scheme recognized as offering adequate protection for the rights and freedoms of Data Subjects as determined by the European Commission; or

    (iii) governed by the Standard Contractual Clauses between the Subscriber as exporter and such third party as importer. For this purpose, the Subscriber appoints BREVORT RIVER STUDIOS as its agent with the authority to complete and enter into the Standard Contractual Clauses as agent for the Subscriber on its behalf.

    4. Data Security, Audits and Security Notifications

    4.05 Any work performed under this addendum is subject to an additional cost to be quoted to the customer. Such cost is to cover the expense of the additional work and nothing in the Terms of Service or this agreement shall be construed to bind Brevort River Studios to perform any additional uncompensated task. Additional tasks will be billed at a rate corresponding to the expertise and time necessary to complete the task.

    4.1 BREVORT RIVER STUDIOS Security Obligations. BREVORT RIVER STUDIOS will implement and maintain appropriate technical and organizational security measures to ensure a level of security appropriate to the risk, including as appropriate, the measures referred to in Article 32(1) of the GDPR.

    4.2 Upon Subscriber’s reasonable request, BREVORT RIVER STUDIOS will make available all information reasonably necessary to demonstrate compliance with this CA.

    4.3 Security Incident Notification. If BREVORT RIVER STUDIOS becomes aware of a Security Incident, BREVORT RIVER STUDIOS will (a) notify Subscriber of the Security Incident within 72 hours, (b) investigate the Security Incident and provide Subscriber (and any law enforcement or regulatory official) with reasonable assistance as required to investigate the Security Incident.

    4.4 BREVORT RIVER STUDIOS Employees and Personnel. BREVORT RIVER STUDIOS will treat the Subscriber Personal Data as confidential and shall ensure that any employees or other personnel have agreed in writing to protect the confidentiality and security of Subscriber Personal Data.

    5. Access Requests and Data Subject Rights

    5.1 Data Subject Rights. Where applicable, and taking into account the nature of the Processing, BREVORT RIVER STUDIOS will use reasonable endeavors to assist Subscriber by implementing appropriate technical and organizational measures, insofar as this is possible, for the fulfillment of Subscriber’s obligation to respond to requests for exercising Data Subject rights laid down in the Data Protection Laws.

    6. Termination

    6.1 Deletion or return of data. Subject to 7.2 below, BREVORT RIVER STUDIOS will, at Subscriber’s election and within 90 (ninety) days of the date of termination of the Agreement:

    (a) make available for retrieval all Subscriber Personal Data Processed by BREVORT RIVER STUDIOS (and delete all other copies of Subscriber Personal Data Processed by BREVORT RIVER STUDIOS following such retrieval). Such data preparation for export is covered in our terms of service and the administrative cost posted there applies in all instances, or

    (b) delete the Subscriber Personal Data Processed by us.

    6.2 BREVORT RIVER STUDIOS and its Subprocessors may retain Subscriber Personal Data to the extent required by applicable laws and only to the extent and for such period as required by applicable laws and always provided that BREVORT RIVER STUDIOS ensures the confidentiality of all such Subscriber Personal Data and shall ensure that such Subscriber Personal Data is only Processed as necessary for the purpose(s) specified in the applicable laws requiring its storage and for no other purpose.
